Relaxation in paying additional fees for delay in filing Form-8 by LLP up to 30th December 2021

 

The Ministry of Corporate Affairs issued a General Circular No. 16/2021 dated 26.10.2021 announcing relaxations in the filing of Form-8 by LLPs. The gist of this circular is as below:

"The Ministry has received a representation seeking extension of timeline for filing the Statement of Account and Solvency without paying additional fees by LLPs on account of challenges faced by the LLPs due to COVID-19 pandemic. As part of the Government's constant efforts to promote ease of living and compliances for Micro, Medium, and Small Enterprises doing business through the vehicle of LLP, it has been decided to allow LLPs to file Form-8 (the Statement of Account and Solvency) for the Financial Year 2020-21 without paying additional fees up to 30th December 2021."

 

Summary: The LLPs may now file Statement of Account and Solvency in Form-8 for the F.Y. 2020-21 till 30th December 2021.

Relaxation in paying additional filing fees for e-forms AOC-4, MGT-7/MGT-7A up to 31st December 2021

 

The Ministry of Corporate Affairs issued yet another circular General Circular No. 17/2021 dated 29.10.2021 announcing reliefs for companies in lines of LLPs. The gist of this circular is as below:

"Keeping in view of various requests received from the stakeholders regarding relaxation on levy of additional fees for annual financial statement filings required to be done for the financial year ended on 31.03.2021, it has been decided that no additional fees shall be levied up to 31.12.2021 for the filing of e-forms AOC-4, AOC-4 (CFS), AOC-4 XBRL, AOC-4 Non-XBRL, and MGT-7/MGT-7A in respect of the financial year ended on 31.03.2021. During the said period, only normal fees shall be payable for the filing of the aforementioned e-forms."

 

Summary: There will be no additional fees on the filing of e-forms AOC-4/ AOC-4 CFS, AOC-4 XBRL, and MGT-7/ MGT-7A for the F.Y. 2020-21 up to 31st December 2021.

 

Extension of the last date of filing Cost Audit Report 

 

The Ministry of Corporate Affairs also extended the last date of filing Cost Audit Report vide General Circular No. 18/2021 dated 29.10.2021. The gist of this circular is as below:

"In continuation of this Ministry's General Circular No. 15/2021 dated 27th September 2021, in view of the disruption caused by the COVID-19 pandemic and after due examination of the representations from the stakeholders, it has been decided to substitute the word and figures "31st October 2021" with the word and figures "30th November 2021" in the said general circular."

 

Summary: The last date of filing the Cost Audit Report has been extended from 31st October 2021 to 30th November 2021.
